Property Assessment By-Law

Property Assessment Bylaw – 2002

The Band Council of the Lower Similkameen Indian Band deems it advisable and in the best interests of the band to engage in, by bylaw, the taxation for local purposes of land, or interests in land, in the reserve, including rights to occupy, possess or use land in the reserve.

Now Be It Hereby Resolved:

That the following bylaw, being the Property Assessment Bylaw, be and is hereby enacted for the purpose of engaging in taxation for local purposes of land, or interests in land, in the reserve, including rights to occupy, possess or use land in the reserve, pursuant to the provisions of the Indian Act and in particular pursuant to the provisions of subsection 83(1) of the Indian Act, and pursuant to the inherent right of self-government,

and,

The Property Assessment Bylaw as enacted herein shall supersede any property assessment bylaws previously enacted by the Band Council and approved by the Minister of Indian Affairs to the extent necessary to give full force and effect to the Property Assessment Bylaw for the 2002 taxation year and all following years,

and,

That upon approval by the Minister of Indian Affairs, the Property Assessment Bylaw shall be of full force and effect.
